Resilience and digital skills could be considered necessary competencies for the individual of the twenty-first century, which the current social reality suggests. For this reason we carried out a research in the institution of higher education -IES- Corporación Escuela Tecnológica del Oriente, of Bucaramanga-Colombia, which had a dual purpose: to describe resilience and digital competence in 356 of its students and establish a comparison between the values of these two aspects and those reported in other HEIs in Mexico, using a (...) quantitative, non-experimental, cross-sectional design and descriptive scope approach, the SV-RES Resilience Scale instrument and a Questionnaire for the study of the Digital Competence of Higher Education Students. How questions and why questions interact in complex ways within biological practice. One of the most fruitful accounts to think about this relation is the widely known systemic approach, which has its origin mainly in the works of Robert Cummins (1975, 1983). As we will show, this approach effectively manages to capture much of what biologists do, especially in areas such as molecular biology, neuroscience and neuroethology. Our aim with this work is to discuss the metatheoretical status of the presuppositions (...) behind systemic analysis. We will hold that these assumptions are of an empirical nature, and that they can be reconstructed as parts of a theory. (shrink)

Allen Carlson's aesthetics of nature contends that a deepening in the scientific knowledge of natural objects and environments is required to achieve an appropriate aesthetic appreciation of them. This 'scientific cognitivism' is often presented as supporting the emergence and development of environmental awareness as well as a theory consistent with the requirements of environmentalism that have been set out by Carlson himself. But Carlson's view about the aesthetic appreciation of contemporary agricultural landscapes gives more relevance to their functional fitness for (...) human purposes than to scientific cognitivism. It will be shown here how this different treatment weakens the link between Carlson's work and his requirements of environmentalism. (shrink)

The act of iudicare hostes (‘declare public enemy’) was a formal pronouncement of the Roman Senate, voted for the first time in 88 BCE following a proposal by L. Cornelius Sulla after his first march on Rome. Legal historians have generally interpreted it as an emergency measure intended to preserve legality in a situation of civil strife and viewed it as a consistently defined institutional framework throughout the final decades of the Republic. Through an analysis of Sulla’s performative political communication, (...) before, during and in the immediate aftermath of the march, this paper argues that the act of judging (iudicare) someone a public enemy (hostis publicus) was first deployed as a political action, void of legal effects. Later instances of iudicare suggest that this act underwent a process of institutionalization after 63 BCE. (shrink)

El sacrificio humano es una imagen frecuente en las religiones antiguas, concretamente en la griega, y su estudio ha levantado numerosos enfrentamientos entre corrientes historiográficas distintas. Uno de los casos más sobresalientes es del culto a Zeus en el Monte Liceo, que aquí analizamos. Las fuentes literarias reflejan la creencia de los griegos en estos sacrificios humanos, así que podemos decir que los sacrificios fueron reales porque fueron usados para construir paisaje y, por lo tanto, realidad.

The topic of the present reflection is Christian religious belief. Specifically, we will use Husserlian tools in order to examine the positional nature of this particular type of belief. We will be less interested in the question concerning the success conditions of this experience and more in its noetic structure. According to our proposal, to believe by faith supposes (although it is not exhausted by) accepting the existence of mundane evidence speaking against this fundamental belief. The believer acknowledges the existence (...) of this contradicting en-doxical basis and nevertheless believes what she believes. We will refer to this simultaneous movement of accepting and cancelling as the concessive structure of the religious attitude. The para-doxical movement of experiencing conflicting evidence as being subjectively ineffective is a key component of this attitude. At least some inchoative conflict with the world is required in order for the religious belief to be religious. Lastly, we will try to show that, with a distinctive terminology, the idea that the Christian religious attitude involves a conflict between subjectivity and world is present not only in Kierkegaard but also in phenomenological figures like Scheler and even Husserl. In this paper I attempt to bring together (at least) two very different debates: one on justice, mercy and particularity, the other on the play of exclusionary reasons. My aim is to show how the discussion of the uneasy co-existence of justice and mercy pivots on the question of particularity. And, secondly, that the debate on exclusionary reasons can show us why law may fail to do justice in this context.

La decouverte de plus en plus profonde de la signification du christianisme a transforme la pensee de Fichte. Reciproquement, Fichte s'engage dans la voie d'une transformation du christianisme, au sens d'une metamorphose de la croyance en vision; il saisit la foi comme un stade imparfait de la science et souligne que seule cette derniere est a meme de supprimer l'exteriorite de l'Absolu. Le present ouvrage allie les points de vue genetique et systematique. Elle examine les differents aspects de la conception fichteenne du christianisme, notamment sa position a l'egard du Nouveau Testament, de la dogmatique, de la morale et de la mystique chretiennes. Por esta razão, A Medicina Antiga é talvez o primeiro reconhecimento deliberado do valor científico do conhecimento aproximado do particular.

Arguing against the long-standing belief that Thuc. 3.82.4 refers to words changing their meanings, this article shows that, according to the passage, the way in which people value actions and apply value-words to actions in peace differs from how they value and apply value-words to the same types of actions in stasis. But the meaning of the value-words themselves remains the same in both circumstances. The passage is about neither meaning nor the propagandistic manipulation of language but about the distorting (...) effect of stasis on the moral assessment of actions. (shrink)

What are the Early Memoranda?1 When were they written? What are their sources? What is their purpose and their relation to Hume's works? These questions, usually addressed separately, are in fact tightly interwoven: they require an articulated response that embraces them all. Our response could be summarised as follows: far from being current reading notes, or even less the exhaustive diary of Hume's intellectual experience, the Early Memoranda are most likely second-tier texts, or—as James Harris recently conjectured—"notes taken from notes."2 (...) The heroic figure is a human fiction of the wholly singular. In the hero, discourses about ideals and exemplariness, extra-ordinariness and exceptionalness, agonality, transgressivity, or good and evil become condensed into a single individual. Thus, the hero is the opposite of the masses. As it is argued in this article, the answer to the question of what distinguishes a hero lies in the supererogatory moment, the reference to the hero’s quality of more than can be expected: the heroic figure does (...) more than he or she has to, more than duty requires of an ordinary person, and this is the reason they are heroized. However, this also points to a dialectic moment of the heroic in which the opposition between the hero and the many seems to be suspended. Following Niklas Luhmann, the hero represents the paradox of conformity through deviance, because through the example of their abnormality they produce in others a desire to imitate them. In the end, there is a collective appeal of the heroic that affects even the conceptual complement of the hero: the crowd which is characterized by the disappearance of the individual within it. Inspired by Luhmann’s sociological reflections on the heroic as well as Elias Canetti’s anthropological perspectives on the phenomena of the crowd, this article traces the rhetoric of the hero along its path from the singular to the plural. Against the backdrop of the analysis of the heroic in revolutionary Iran, a generalizable typology is proposed that distinguishes between the hero, the collective of heroes, the heroic collective, and collective heroism. This order reflects a progression that is analogous to the conjunction of the one and the many, moving qualitatively from the distinct figure of the hero to the indistinguishable masses. (shrink)

This article aims to present four case studies of the different responses to governmental measures to fight the COVID-19 pandemic by supreme and constitutional courts, especially in cases of jurisdictions that have been facing democratic erosion. The spread of the COVID-19 pandemic demanded immediate public policies and other political decisions from the branches of government. Executive authorities were the main actors in effecting constitutional public health norms. The expectation was that they will abide by the rule of law in fulfilling (...) their duties; that has not been the case under governments that promoted democratic erosion. The different contexts of the threats posed to the constitutional democracies led populist and illiberal leaders to opportunistically either try to—and then be contained by courts—or effectively consolidate the expansion of powers under the conditions of the pandemic. Concentrating on four jurisdictions (the USA, Hungary, El Salvador, and Brazil), the article demonstrates that courts can effectively work as bulwarks against waves of democratic erosion, especially in situations of stress, as it was the case in the global COVID-19 pandemic. This hypothesis is also proven by episodes in which courts did not sufficiently operate to curb illiberalism because they were already captured. The analyses enable classifying the court’s responses to the COVID-19 executive measures in a threefold pattern: deferential, restrictive, and of forced capitulation. (shrink)
